The Enforcement Directorate has approached the Delhi High Court against the trial court's order granting bail to Delhi Chief Minister Arvind Kejriwal yesterday in the Delhi liquor policy case.

A bench comprising Justice Sudhir Kumar Jain and Justice Ravinder Dudeja has agreed to hear the ED's challenge today itself after an urgent mentioning was made by Additional Solicitor General SV Raju.

ASG SV Raju appeared for ED and mentioned the matter before the court. He prayed that the bail order be stayed.

“There is a matter where I'm moving for urgent stay. The order has not yet been uploaded. Conditions not known. We have not been given full opportunity to oppose the bail application,” he said.

ASG further said that while the law says that the public prosecutor must be given full opportunity to argue, but he was not given such an opportunity and his arguments were curtailed.

Senior Advocates Abhishek Manu Singhvi and Vikram Chaudhari appeared for Kejriwal. Chaudhari said that ED should "gracefully accept" the order.

“Let the file come… I have not passed the final order. The file will come to me in 10-15 minutes. Then you can make detailed arguments,” the bench said while allowing the listing for today.

Singhvi: There are nine summons to me. I reply to each summons and in the first one of CBI, I also go and give my statement but I don't go on summons by ED.

Singhvi: Your lordships doesn't need summons to arrest me. Of an FIR and ECIR of 2022, and summons starting from Mid 2023, no arrest of Kejriwal till March 2024. Elections are announced. I made the mistake of going to a court seeking anticipatory bail. Your lordships grants notice. Can that be ground of arrest? That is how I am arrested.

    • 21 Jun 2024 10:27 AM GMT

Singhvi: He got bail on the understanding, on inducement. That's how the ED functions. Then the bail gets absolute and he gets pardon.

Singhvi: The most important is Sarath Reddy who gets out on back pain.

Singhvi: Nine statements not implicating me. Then after these statements he implicates me and then he gets bail on back pain without any objection.

Singhvi: The father gives a statement totally in my favour. MSR not arrested till now.... Now, his son is arrested. He desperately has to get out of jail. This attempted suicide application is opposed by ED. Then, desperate father implicates me. Next day his son gets bail.

    • 21 Jun 2024 10:24 AM GMT

Singhvi: When judge says 2022, she is right. Then four statements in 2022 none of which implicate me. Names are Raghav Magunta, Buchi Babu, Abhishek Boinpally and Sarath Reddy. None of them say a word about me. Then the father of Raghav who is MSR records a 164 statement and mentions for the first time that I spoke to him about liquor business.

Singhvi: Three arrests have been made by them. Note the dates of arrest. Prior to arrest, nothing implicating me. The arrests are in November 2022 and Feb 2023. Buchi Babu statement is while he was in custody and he gets bail immediately.

    • 21 Jun 2024 10:19 AM GMT

Singhvi: Before I read findings, I want to show list of dates. These submissions read with list of dates validate the findings. This was given to the special judge also.

    • 21 Jun 2024 10:18 AM GMT

Singhvi reads the trial court order.

Singhvi: All this evidence and material was there and then the findings were given.

    • 21 Jun 2024 10:13 AM GMT

      Singhvi rejoins the proceedings.

Singhvi: Just glance at these paras. Turn to the judgement. The judge notes that I am not in ECIR and not in CBI FIR.

    • 21 Jun 2024 10:13 AM GMT

Chaudhari: As I see it, it is ED's take, my way or highway. Please look at the order itself. From page 1 to page 15, are only the contentions of both sides.

Chaudhari: The judge in her own language decipher the contentions of both sides. Also categorises them in numbers. On page 12, arguments of ED.

    • 21 Jun 2024 10:08 AM GMT

Chaudhari: If I can take it... I'll just wrap it up. Then Mr. Singhvi can continue.

ASG: There cannot be two wrapping up.
