Singhvi: I am in complete violation of procedure under Article 21. I am already in ED custody. While I am in custody, almost two years after August and one year of interrogation, application is made to examine me in JC in terms of Section 41A crpc.

Singhvi: My second point... It is general law not a special law. You can't deal with me in violation of the most overarching fundamental right of liberty and procedure established by law.

    • 17 July 2024 11:26 AM IST

Singhvi: If CBI can come in June and say I never called you in two years after CBI FIR and I am calling you after SC released you... This is my first point. See the dates and overall context. This is common sense. The dates cry out for themselves. Because the insurance arrest is necessary to keep him behind bars.

    • 17 July 2024 11:24 AM IST

Singhvi: Unfortunately for me I am back to square one because its insurance arrest. Because those who want it, by hook or by crook, he is behind bars.

Suddenly this man is very important to be interrogated in June and taken into custody.

    • 17 July 2024 11:24 AM IST

Singhvi: When I am produced before vacation judge, they start the procedure of asking for custody, remand etc. The date is June 26 when the CBI gets active. On July 12, I get released by SC.

    • 17 July 2024 11:23 AM IST

Singhvi: I am secure in ED. Nothing can happen and the SC grants me release. Although for three weeks. SC doesn't think I can non cooperate or influence witnesses. It is not giving me in fun. SC tests my bona fide. I go back dutiful back to jail on June 2.

Singhvi: Common sense tells you there can't be any grounds of arrest in this kind of situation. The special judge grants me bail on June 20. It is clear as daylight that psychological winds of change are growing in CBI's mind. I won't say it's CBI, I would say there are others in whose mind there is psychological change.

Singhvi: I ask myself, this is happening in April, 8 months of 2023 go by. It's 240 days, CBI didn't think to arrest or interrogate me. Three months of 2024 go away, 21 March, exactly 11 months after recording of 9 hours, after MCC comes into force, I am arrested by ED.

Singhvi: I am in custody. In that situation, frankly, its a rarest of rare case. I am in custody and you're called in custody by CBI.

    • 17 July 2024 11:18 AM IST

Singhvi: 17.08.2022, just shy of two years, the CBI FIR is there. I am not named. 14.04.2023, admittedly I received summons as a witness. Just under one year after the FIR. I appear for nine years on 16.04.2023, two days later.

    • 17 July 2024 11:18 AM IST

Singhvi: He has got a regular bail in PMLA. It has been stayed and it will be decided in that court. The stay makes it clear that it will be decided on merits. There is interim bail also.

It's an afterthought insurance arrest. Please note five dates.

    • 17 July 2024 11:18 AM IST

Singhvi: Because your lordships doesn't have stringency of PMLA, today under that law I have three orders in my favour. One has been stayed by this court.

Singhvi: The very act of release and re surrender in June shows complete satisfaction of triple test. The SC last week thought it fit to release him indefinitely.

Singhvi: Today I m supposed to be begging in CBI case, in a non section 45 case, non PMLA case, please keep these factors in mind.
