The Allahabad High Court has directed the Additional District Magistrate, Lucknow to file an affidavit regarding the steps which have been taken or are proposed to be taken for proper implementation of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 within three weeks.

This order comes days after the bench of Justice Devendra Kumar Upadhyaya and Justice Shree Prakash Singh had expressed its concern about the reported deficiency in the implementation of "The Senior Citizens Act, 2007" and the rules framed thereunder, in district Lucknow.

The court was essentially hearing a PIL plea moved by one Jyoti Rajpoot with a prayer regarding the proper implementation of "Maintenance and Welfare of Parents and Senior Citizens Act, 2007" and Rules framed thereunder. The plea had also raised concerns about the problems being faced by unattended, sick, and abandoned senior citizens.

The plea had also sought relief for an old lady named Anjali Devi, who was left abadoned. However, after the Court's order, the authorities shifted her to the Old Age Home run by the State.

Now, on August 23, when the Court was informed that various steps have been taken for appropriate implementation of the aforesaid Act and rules made thereunder, the Court sought the affidavit as aforesaid and further directed that the affidavit be filed under the order shall be sworn by the Additional District Magistrate, Lucknow and shall be prepared in consultation with other two officers namely District Social Welfare Officer, Lucknow and the District Probation Officer, Lucknow.

Further, the Court also sought an affidavit reflecting upon the condition of the Old Age Home run by the State and for the said purpose, the Court directed, that a report be submitted by the District Welfare Officer, Lucknow. With this, the Court posted the matter for further hearing on September 13, 2022.
