Plea In Bombay High Court Seeks Stay On Release Of Film On Life Of Sushant Singh Rajput

A petition has been filed in the Bombay High Court seeking injunction restraining the release, exhibiting, displaying and broadcasting of film relating to the life of late actor Mr. Sushant Singh Rajput titled "Nyay, the Justice".
The plea has been filed by one Manish Jamadar Mishra, a businessman and a social worker by profession, challenging an order of the City Civil Court, Bombay dated 22nd December 2020. As per the said order, the Court had rejected the prayer made by the plaintiff seeking injunction of the said film.
The matter had come up before Justice PK Chavan on Wednesday. However, Justice Chavan did not find any urgency in the matter. In view of this, the hearing has been deferred till first week of March.
According to the said plea, it is the case of the petitioner that Sarla Sarogi, the producer of the film was "trying to malign the reputation of present Government of Maharashtra by way of mentioning that the Government has failed to take any steps in respect of death of actor Mr. Sushant Singh Rajput."
Moreover, according to Mr. Mishra, he is "emotionally attached" to the late actor Sushant Singh Rajput and the government of Maharashtra.
Therefore, Mr. Mishra had prayer for a temporary injunction on the release of the film "Nyay, the justice".
According to the city civil court, the defendant producers opposed the said case by submitting that Mr. Mishra did not have a locus standi to file the case. Moreover, it was submitted that the contentions raised by Mr. Mishra are contrary to the provisions in law therefore, making the suit premature.
In view of this, the City Civil Court had ordered:
"It is pertinent to point out here that as per the case of the plaintiff that the said film is yet to be released. Unless, the contents of the film are watched, it is difficult to hold that the contents of the said film malign the reputation of actor late Mr. Sushant Singh Rajput and the present State Government. The plaintiff has failed to make out a prima facie case and balance of convenience in his favor. Further, the plaintiff has failed to establish that he would suffer irreparable loss in case of refusal of injunction as prayed."
