Man Accused Of Outraging Modesty Of Women Granted Bail By Bihar Court On Condition Of Cleaning Drains

A Bihar Court last month granted bail to a man accused of outraging the modesty of women on the condition of cleaning, maintaining, and supervising the drains (Nala).
The Additional Sessions Judge Avinash Kumar from Jhanjharpur, Madhubani put this condition taking into account the statement of counsel for the petitioner that the petitioner shall clean, maintain and supervise Nala(drain) situated in front of his house.
The bail petition had been filed by the petitioner Rustam, who is in jail custody since April 24, 2021 in connection with a case registered under Sections 341 (punishment for wrongful restraint), 323 (punishment for voluntarily causing hurt), 308 (attempt to commit culpable homicide), 324 (voluntarily causing hurt by dangerous weapons or means), 354(b) (assault or use of criminal force to woman with intent to disrobe), 379 (punishment for theft), 504 (intentional insult to provoke breach of peace), 506 (criminal intimidation) r/w Section 34 (common intention) of the Indian Penal Code.
The allegation in the FIR as per the informant-Md. Amjad was that on August 11, 2020, on the occasion of the marriage of his daughter, the accused-petitioner allegedly outraged the modesty of many women and that he allegedly attacked and assaulted the informant side.
The counsel for the petitioner submitted that he is willing to do some social service to show his bonafide without prejudice to his right.
Therefore, on the suggestion of A.P.P., the counsel for the petitioner agreed that the petitioner shall clean, maintain and supervise the Nala(drain) situated in front of his house.
With this, the Court granted him bail while ordered thus:
"...he is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned court below with condition that as per the statement of counsel for the petitioner, the petitioner shall clean, maintain and supervise Nala(drain) situated in front of his house."
