Delhi Court Grants Bail to Shaheen Bagh Shooter Kapil Baisala [Read Order]

The Saket District Court in Delhi has granted bail to Kapil Baisala who was arrested by the Delhi Police on February 1, 2020 allegedly for firing in the air during anti-CAA protests in Shaheen Bagh.

After hearing the arguments advanced by Baisala's counsel Advocate Narveer Dabas, Additional Sessions Judge Gulshan Kumar released him on bail while stating,

"On considering the totality of facts and circumstances, the accused Kapil Baisala is admitted to bail on furnishing bail bond in a sum of Rs 25,000 with one surety in the like amount to the satisfaction of Ld. MM."

Advocate Narveer had submitted that the FIR in the case was filed with an unexplained delay of 6 hours and that the accused had been falsely implicated for the crimes he never committed. He contended that the accused had been languishing in custody ever since arrest and nothing had been recovered from him. He further pointed out that the investigation was almost complete and thus the accused was no more required for inquiry.

Baisala was arrested on February 1 and later the custody was taken over by the Crime Branch for 6 days, when they took over the case. Thereafter, on February 8, he was sent to Judicial Custody and has been there till date.

His counsel argued that the complainant and other witnesses in the case were police officers and as such there were no apprehensions of influencing them.

Allegedly, Baisala fired a shot in the open air at Shaheen Bagh, during an anti-CAA protest. When the police ran to catch him, he fired another shot. He was arrested from the spot and two empty shells of fired bullets were also recovered from there.

Opposing the bail plea, the respondent authorities stated that the allegations against Baisala were very serious and the case was only at its initial stage.
