    The Gujarat High Court Advocates' Association (GHCAA) in its Extra Ordinary General Meeting on Wednesday (January 22) distanced itself from the statements made by the advocate general and the other members of the bar during their interaction with the Chief Justice's bench on Monday over an incident involving an exchange between the bench and GHCAA President Brijesh Trivedi. 

    The development comes in light of last Friday's incident concerning an exchange between GHCAA President Brijesh Trivedi and the Chief Justice's bench following which the High Court had in its order deprecated Trivedi's conduct in seeking an adjournment in a 2011 PIL observing that manner in which he acted indicated that he was trying to misuse his position as the elected President of the Bar for "creating his nuisance value in the Court". After this incident, on Monday several members of the bar along with senior members such as the advocate general had conveyed to the court about a mutual respect between the bar and the bench adding that the incident should not have happened.

    The GHCAA in its resolution notes that the representation made on Monday before the Chief Justice's court was a personal view of the Advocate General as well as others present there. 

    "It has been clarified by the Learned Advocate General and other present in the 1st Court that the representation made on 20.01.2025 at 11 a.m., was their personal view and not the view of Bar. Hence the Bar does not approve of the same," the resolution states. 

    The association thereafter unanimously resolved that in future no one will represent the Bar without the authority in the future.

    "The Bar unanimously resolves that in future, no one will represent the Bar without authority. The authority will only be by the way of Resolution of Managing Committee or the General Body," the resolution states.

    The agenda of the meeting was to discuss the incident occurred which had occurred last Friday (January 17) during the hearing of a 2011 PIL where the Bar President was appearing as well as the representation between the senior members of the bar on Monday. 

    The Circular for the Extra Ordinary General Meeting noted, “It is pertinent to note that certain decisions on administrative side have been creating difficulties for the advocates and the issues raised by the President during the so-called mentioned those issues. Therefore, please clarify the stand of the managing committee on the issues mentioned herein above, or call the extraordinary general meeting so that necessary resolutions can be passed by general body on the above matters. Till date, none of the representations made by the bar, have been replied and the litigants and Advocates and their clerks are suffering due to these issues.”
