Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has prepared a standard format for written arguments to ensure the speedy resolution of ongoing cases at its headquarters and regional offices. This format requires the complainant to provide a complete description of their property, the sale agreement, payments made to the promoter, their complaint, and the requested relief in writing before the RERA bench.
This standardized approach will bring clarity to the complainant's requested relief, leaving no doubt in the minds of any parties involved. After the complainant's written argument, the RERA bench will issue its final order, ensuring compliance with the order.
The reason behind this initiative is that, in several cases, the authority found that complainants were changing their requested relief after the RERA bench made decisions. This lack of clarity led to confusion and doubts regarding the final order, causing unnecessary delays in resolving complaints.
According to UP RERA Chairman Sanjay Bhoosreddy, “In many cases, we have seen complainants deviating from their requested relief, resulting in a waste of time and effort for both the authority and other parties. To strengthen the judicial process, the authority will now issue final orders based on the written requested relief submitted by the complainant, ensuring the complainant receives a satisfactory final order, does not deviate from their requested relief, and ensuring the lawful resolution of the complaint.”
The authority will soon introduce a similar standard format for promoters to ensure harmony between both parties after the final order and achieve a 100% resolution of cases.
