Sibal: They said there’s inaction on part of the state, etc.
What happens is this is flashed all over the country, there’s a matter of reputation of the state also. You don’t give us an opportunity, you castigate us & you pass an order!
Sibal for West Bengal: We sought that findings of order on 18th June against the state may be expunged, as remarks were made against the state!
Justice Saran: Where are these remarks? We understand they asked NHRC to see if complaints have been looked into or not.
Sibal: This is the proposition that I made with respect to natural justice. You want to investigate beyond list II in a federal structure and give investigation to someone else without giving us an opportunity!
Sibal: In the recall application, I tell the court that I don’t have the report,
I don't know what the complaint is.
Sibal: Despite the short time, we produced a chart! How do they come to such conclusions in their order? These are allegations!
Sibal: We sought recall of the order in 3 days. They say facts were established, how were they established?
Sibal: This is unknown to law, a committee that follows a procedure unknown to law, and yet it's on basis of this committee’s report that it was said you go to CBI or SIT.
Justice Saran: Maybe what they mean is examine here and come with a conclusion. What you’re probably meaning to say is examination means investigation, and that they can’t do.
Sibal: The order said, persons prima facie responsible for crime and the officers who maintained calculated silence on the issue be pointed out.
What is the limit of this committee? There can be no ascertainment of facts without investigation.
Sibal: The order said, Committee will examine all cases & maybe by visiting affected areas and submit a comprehensive report with the steps to be taken to ensure the confidence of people that they can peacefully live in their houses, and also carry on their occupation.
