Bench: Just listen. Vikas Singh also wanted to touch merits. We stopped him also. So far as background is concerned, we have seen.

SG: Matter was heard for 2 hours. I moved an application for transfer of trial and declare proceedings void ab initio.

Bench: You’re going into merits of the matter. Please restrict yourself to grant of affidavits being taken on record.

SG: Trial Court granted bail. We were unable to produce the accused due to certain circumstances, so we moved the Chief Justice.

Bench: We’ve noted that.

SG Tushar Mehta: I will dispute some facts which were not correct.

Bench: You’re saying that at the first opportunity you filed it.

Singh: No time was granted. I only filed it as a courtesy. CBI filed Affidavit on 2 June without taking liberty. They brought up new facts.

Singh: 31st May, I raise an objection to maintainability. They said that they would hear that. They also said that they were hearing on the recall first. So the main writ petition was not to be argued at all.

Singh: 27 May order - State is impleaded on the orders of the Court. I wasn’t a party in the 19th May plea. I was impleaded for the first time.

Bench: Law Minister and CM were ?

Dwivedi: Yes, but they were asked to be served on 27th.

Singh: No averment was made to the Trial Judge that we have already moved the HC.

Bench: You’re going into the merits.

Singh: I’m using my 5 minutes only to say what Dwivedi hasn’t said.

Sr. Adv. Vikas Singh argues for the State: My reply was filed as a courtesy.

Bench: We will do that discussion later. The Court presumed.

2021-06-25 06:15 GMT

Bench: We permit you to argue your entire case fully.

Dwivedi: One sentence. The idea of lacunae is pertinent to civil jurisprudence and has no relevance in criminal because here both the CBI and Court must endeavour to find the truth.

Bench: Thank you. You’ll remember the word from Court 29 in Allahabad.

Dwivedi: Yes, when the Court says Thank You, that means stop.

SG: On the lighter side, Thank You means Shut Up.
