DP Singh resumes his submissions.

Singh: They said they have been released in three orders. I'll read some portions. Please see in what circumstances, does it even merit to say that it was such a release that they can boast about it? We are not Pakistan as argued by them. That's the strength of our judicial system.

Singh: I don't know whether the court will allow his remand or will give him bail. But he would have been inside in ED case. Where is the issue of overreaching arrest? Because I don't want to use the term and give it any more credence.

Singh: When do I arrest? Only after this court already granted complete stay on his release in ED case. Where is the question?

We don't deal with what can and what will happen. I've to show justification that it was not the way as they say, to keep him inside.

Singh refers to Delhi prison rules: Its between the agency and court... If there was an insurance arrest, I could have exercised my right to arrest in terms of Section 41 itself. But I don't do that. We come back and assess his statement. And then we decide we need to arrest him. Application was moved only after this court granted complete stay on his bail. Insurance arrest is something, though it doesn't mean anything...it would have been that I could have arrested so that I could have preclude whatever I am not aware of.

Singh: If I have to interrogate someone, I don't have to tell anybody or to give prior notice to them.

2024-07-17 07:42 GMT

Singh: On June 24, I examine him but don't arrest him. They say in hearing there was no notice. Kejriwal is in custody of court and prison rules mandates that I've to seek permission of court to go to jail to interrogate him.

Singh: We have this plan A and B both. Then he is granted bail in ED case on June 20. But on June 21 there was an interim stay on release. I could have arrested him then. But because hearing was going on. It was heard till late evening. Monday it was delivered and stay was confirmed.
