Arvind Kejriwal's Plea Against CBI Arrest : Live Updates From Delhi High Court

The Delhi High Court will hear today the petition filed by Delhi Chief Minister Arvind Kejriwal challenging his arrest by the Central Bureau of Investigation (CBI) under the Prevention of Corruption Act in relation to the liquor policy case.

Justice Neena Bansal Krishna will hear the matter. Last week, the Supreme Court had granted interim bail to Kejriwal in the case registered by the Enforcement Directorate under the Prevention of Money Laundering Act in relation to the same liquor policy case.

Singh: They say nine hours were taken. He took his own time to answer question. Every question was typed. When he was asked to go. He said no I have to read entire thing, he made some corrections. There was a big crowd outside CBI office wanting his release at the earliest. The question is who will decide how to investigate a case?

Singh: As far as accused go, they have all special rights and privileges. And on the balance which statute provides, the privilege with investigating agency is far less than accused.

Singh: Kindly have two dates. I call him under section 160. They say we called him as witness. There is no justification. Section 160 isn't for witness, it is to call anybody who is acquainted with facts of case. It can be a suspect, accused or witness.

CBI SPP DP Singh commences submissions.

Singh: As a prosecutor, I don't have a privilege to use terms which statute doesn't permit and has not meaning. Using term insurance arrest, power of arrest by office is one thing. It being tested by a court is another. Using such term is not justified.

Singhvi: The blood sugar level has declined. The high part is still manageable but the sweeping low part is dangerous. Take a holistic view, triple test view.

Singhvi: In any case the simple test is triple test. In common sense, I always call common sense is paramount. Can I go an touch the evidence? I cannot. What will be the evidence issue? Can I do non cooperation? If you want to have coffee every week, I'll come. Flight risk has become very limited ground. Which test are you talking about? That I am a threat to society, on what basis? Everybody is getting bail, ironically my party's name is Aam Aadmi Party, but this fellow is not getting bail.

Singhvi: All is decided, remand, arrest, seeking examination. These are the grounds of bail actually. Going to the trial court would be a futile exercise.

CBI's counsel: We will continue till 4 PM because I have a flight tomorrow. I made a request to finish it today.
