The M. K. NAMBYAR MEMORIAL LECTURE SERIES by Prof. G. Mohan Gopal is being organized under the auspices of The M.K. Nambyar SAARC Law Centre at NALSAR, Hyderabad.

Topic: The Roles of the Constitution and the Supreme Court in India's Struggle for Democracy

The M.K. Nambyar SAARC Law Centre for Advanced Legal Studies was established in 2003 at NALSAR under the patronage of Mr. K.K. Venugopal, Senior Advocate, Supreme Court of India. Recently revitalized with the appointment of Justice S. Ravindra Bhat (Former Judge, Supreme Court of India) as Chair of Comparative Constitutional Law Studies, the Centre focuses on academic research, writing, and deliberation on Indian constitutional law, comparative constitutional law, and legal issues affecting South Asian nations.

PROF. MOHAN GOPAL

Prof. Gopal is a distinguished legal scholar who currently works independently with civil society to defend pro bono constitutional rights of marginalized sections.

Prof. Gopal has previously served as Director of the National Judicial Academy and as Director (Vice-Chancellor) of the National Law School of India University, Bengaluru. He was also the founder chair of the Supreme Court's National Court Management Systems Committee.

This lecture by Prof. Mohan Gopal is the first of its kind, as part of the M.K. Nambyar Memorial Lectures to be held annually. The lectures are intended to be a long form series, delving deep into a constitutional issue, organised over the course of several sessions. The lecture series is designed to foster meaningful dialogue and deepen public understanding of critical constitutional law issues.

  • The first part of the lecture will discuss the role of the Constitution as a sheet anchor, imperfect though it may be, for the struggle for democracy in India.
  • The second part of the lecture will identify selected illustrative areas in which counter-democratic judicial interpretations have neutralized the democratic potential of the Constitution and weakened the struggle for democracy.
  • The third part of the lecture will analyse the reasons for the counter-democratic role of the judiciary and suggest potential remedies.
