WhatsApp Privacy Policy: Supreme Court Constitution Bench Hearing- Live Updates
Divan: Subsequently there is a cleavage in the WhatsApp privacy policy which is applied to Europeans and the one applied here. The standard used in EU is much higher and privacy enjoyed by them is of higher order.
Divan: Indian users ought not be disadvantaged qua users in the global jurisdiction because privacy now is a fundamental right and has global implication. It is global human rights. In absent of local laws global corporations have to adopt a golden standard.
Divan: Then the matter came here and it was thought that their are substantial question of law. But no issues were formulated...
Bench: Why is it before a Constitution Bench?
Divan: There is a messaging service called WhatsApp. The company was taken over by Facebook. There was a change in Privacy policy. That was subject matter of challenged by High Court.
Sr. Adv. Kapil Sibal: It has to be formulated.
Solicitor General: It was mentioned in the last order that there is a Draft Bill. That Bill is withdrawn and a new bill will be introduced in the next session of the Parliament
The matter is listed before a Bench comprising Justices K.M. Joseph, Ajay Rastogi, Aniruddha Bose, Hrishikesh Roy and C.T. Ravikumar
