A #ConstitutionBench of the #SupremeCourt to hear pleas challenging WhatsApp's 2021 Privacy Policy
The Bench lists the matter on 17th Jan, 2023 for final disposal. By 15th Dec, 2022 pleadings in all these cases to be completed.

Adv. Vrinda Bhandari(IFF) intervenor points out the issue of data localisation.
Counsel: Notice may be issued in our intervention application.
SG: You have to comply with the laws of India and treat Indians equally with global users.
Divan: I am fine with January. But then it be fixed for final hearing.
Bench: A direction was given by the Delhi High Court.
Sibal: We have complied with that.
Sibal: For EU is different, bur for all other jurisdiction this present law is followed.
Bench: Indian WhatsApp users are the highest in the world. So, the advantage and disadvantage qua the largest group of users is perceived here.
Sibal: The issue is not whether it is largest user or not. It is on the law framed by the Parliament in the respective country.
SG: A Bill was there. The matter was listed late, so I could not seek instruction
SG: So far as the petitioner’s contention is concerned, it is the stand of the Govt. that Indian users cannot be discriminated against the other users of WhatsApp. GoI is alive to the situation and bill in underway. Can this be kept after the Bill is in place.
Bench: If the GoI is keen on having a legislation it could have put it in place.
Divan: It was heard by a Constitution Bench on several days.
Sibal: Not, only on one day.
Divan: It was heard on maintainability. Please place this on some date. We will take less than 2 sessions.
