Kaul: My case is not that majority cannot be incurred in 2(1)(a). My case is that the speaker has to decide it. That you want to bypass the constitutional functionary and come to Supreme Court. My case was on Nabam which is entirely different.

Kaul: My case is that legislature party and the political party go hand in hand and you are seeking an artificial distinction between the two. 

Kaul: In a much worse case (Yediyurappa), the court held that 2(1)(a) was not attracted. If it is, internal dissent which is the bedrock of democracy will be thrown out.

Senior Advocate NK Kaul: I will distinguish between other judgements and this case. There is an artificial distinction sought to be created between the legislative and political party. This isn't our case.
