Supreme Court Dismisses Petition Seeking Review Of Judgment Which Struck Down Electoral Bonds Scheme

The Supreme Court has dismissed a petition seeking a review of the Constitution Bench judgment which struck down the Electoral Bonds scheme as unconstitutional.

A bench comprising Chief Justice of India DY Chandrachud, Justice Sanjiv Khanna, JB Paridwala and Manoj Misra dismissed the review petition filed by Advocate Mathews Nedumpara and another

"Having perused the review petitions, there is no error apparent on the face of the record. No case for review under Order XLVII Rule 1 of the Supreme Court Rules 2013. The review petitions are, therefore, dismissed," the Court observed.

It was on February 15 that the Supreme Court struck down the 2018 amendments made to the Finance Act, Representation of the Peoples Act, Companies Act and the Income Tax Act which paved the way for the anonymous electoral bonds scheme in Association for Democratic Reforms v. Union of India. The Court observed that the voter has the fundamental right to know the source of the funding of the political parties and the scheme infringed that right.

Following that, the Court directed the State Bank of India (the bank which issued the electoral bonds) to disclose the details of the purchasers and the recipients of the bonds.
