[Rhea Bail Hearing-LIVE UPDATES] Bombay HC Hearing On Bail Application Of Rhea Chakraborty And Others In NDPS Case
Justice Kotwal : Suppose, a son is a drug addict and a father procures drugs for his son out of his desperation, will you punish the father for 10 years?
Justice Kotwal : When you arrest, you have to be very careful so as not to leave a mark on a person who is not a nuisance to the society.
ASG Anil Singh says that the NDPS Act also has provisions for reformation of drug addicts.
J Kotwal : Is it necessary to arrest persons if the intention is to reform? Will not arrest cause irreparable harm?
ASG Anil Singh now starts submissions for the NCB
The judge asks all applicants the dates of recording their Section 67 statements.
Maneshinde : Rhea's statements were recorded on September 6,7 and 8. On 8th itself she retracted her statements.
Rathod : A co-accused, who was a supplier, has been granted bail but a servant who was only acting as per master's orders has not been granted bail!
Rathod : Sawant is not a seller or a consumer of drugs. He only used to collect the drug packets for his master Sushant Singh Rajput.
Advocate Rajendra Rathod begins his arguments for Dipesh Sawant.
"Role assigned to me was similar to Desai's applicant. I only used to fetch the packets delivered below the house of #SSR"
Desai refers to the SC judgment in "Ram Singh vs Central Bureau Of Narcotics" (2011) which held that a servant cannot be held to be in possession of contraband belonging to his master unless it is proved that it was left in custody over which he had absolute control.
Desai(lawyer for Miranda, Sushant's help) : This is a case where my continued custody is not warranted.
