Plea To Cancel NEET-UG 24 : Paper Leak Happened Before May 4th, Says CJI; Live Updates From Supreme Court [July 22]
Counsel : 44 students got full marks because of the grace marks given for this ambiguous question.
Counsel : The question is to be deleted.
Cites the decision in Kanpur University v. Samir Gupta judgment. It held that if a question is ambigious, then the question should be deleted.
Counsel : I decide to not attempt because I know there is negative marking. I have done extremely well except for this question. I am in rank 311 currently. If I am given four marks for this question, I will move up.
Counsel : NTA says if there are two correct options, attempt any. But I cannot make the determination that there are two correct answers at the time of exam. I cannot assume that there are two correct answers and marks will be awarded for both.
A counsel for a petitioner who got 711 marks challenges a question which had ambiguous options. Therefore, she chose not to attempt the question. NTA gave full marks to candidates who answered either of the options. Counsel says had the NTA refused to give marks, the petitioner would be in the top.
Counsel takes objection to the NTA opening a 24 hour window on April 9 allowing 24,000 students to additionally register for NEET.
The candidates who were not vigilant in filling the forms in time shouldn't be given additional opportunity.
Counsel : How did the NTA come up with the figure of 1563 students on June 4, when on May 5, they talked about only one centre in Sawai Madhavpur?
"Even if, one undeserving candidate, a beneficiary of such illegal machination, though undetected is retained in the process it would be in denial of, the claim of more deserving candidates"- counsel quotes from "Tanvi Sarwal".
Counsel : In Tanwi Sarwal, the Court ordered re-test for AIPMT about 6 lakh students, when at least 44 were found to have taken unfair means.
Counsel quotes from "Tanvi Sarwal" case :
"We are aware, that the abrogation of the examination, would result in some inconvenience to all concerned and that same extra time would be consumed for holding a fresh examination with renewed efforts therefor. This however, according to us, is the price, the stakeholders would have to suffer in order to maintain the impeccable and irrefutable sanctity and credibility of a process of examination, to assess the innate worth and capability of the participating candidates for being assigned inter se merit positions commensurate to their performance based on genuine and sincere endeavours."
