Hijab Ban- Karnataka High Court Single Bench refers the HIJAB matter to a larger bench. LIVE UPDATES
Adv Tahir: Life of children are getting disturbed because of this legal issue.
Justice Dixit : When are schools reopening?
AG : Monday.
Advocate General opposes grant of interim relief to allow students to attend colleges wearing hijab.
"Interim order at this stage will be amounting to allowing the petition", AG says.
AG: In Shayra Bano judgement, it is said that Hadith is to be treated as a secondary source.
AG refers to the observations in the judgment saying that there are possibilities of different views of the matter.
AG : In fact his lordhsips recognises that there could be a different view.
AG: Justice Mustaque judgement which is so called against the state, kindly refer to it.
AG refers to the judgment.
AG: Children must attend the class adhering to the dress code prescribed by the college.
AG: There are large judgements which say that hijab does not form integral part of the religious practice. The test that if they don't practise the religion itself goes.
AG: I wanted to say the petitions are misconceived. They have questioned the govt GO. Each institution has been given autonomy. State does not take a decision. Therefore prima facie case is not made out.
Adv Raj: If lordships are referring to the larger bench, even the learned AG will agree that students are permitted to enter the class. That will be a great judicial reply.
Kamat: Lordhips may say that all the questions be kept open, prima facie since the students were going to the colleges, keeping all questions open, let the students study for the next two months. Kindly make some arrangements for interim.
