Bench: Identify a competent authority who can certify that a student is unable to appear due to COVID related issues.
Bench: RTPCR is no determination at all. Sometimes it shows negative and person has symptoms.
Srinivasan: If they are affected and they produce a certificate -
Srinivasan: The Court permitted when cases were 45,000. Now it is 37000.
Bench: We are not doubting your intentions. We are saying that those who cannot appear can get a certificate.
Srinivasan: On the one hand, last year, exams are usually held in May. This time we couldn’t hold because of the second wave which was disastrous.
Bench: A general approach can be adopted. If a certified copy from an official is given that he cannot appear for a genuine reason and can appear in the next exam. One possibility is I am infected or one possibility is that family member is infected.
Bench: Mr. Srinivasan, this condition you are mentioning here. RTPCR may be very difficult because you don’t know. Persons who are not infected before 21 June will get infected. Those who have recovered also have longterm problems. There are different situations.
Arora: Centres will only be 4-5 in a State. Students will be all across the State. Example - they have closed the Dimapur centre and now all candidates will have to go to Guwahati. What about containment zones ? What if they can’t travel ?
Arora: Their notification states that they can only get an exemption if they have a positive report after 21 June. Let me place examples of how this is not sufficient.
Bench: You have to submit a report if you were infected or not infected after 21 June. This is the case.
Arora: There is a serious reservation about the fact that there can’t be a RTPCR report just for 21 June. There can be a myriad reasons one cannot take the exam.
