AG : Please see, State is not interfering. We are saying uniforms as prescribed by the CDC must be worn.
AG : Second, in so far as Govt PU Colleges are concerned, we say, it is ordered that colleges under jurisdiction of PU Department, uniform prescribed by CDC is to be worn.
AG : Ultimately what have we directed in the order? The State govt has ordered that students should wear uniform prescribed by colleges.
CJ : Govt has not prescribed any uniform?
AG : Yes, in so far as govt schools. Children are given free uniform in govt schools.
AG: When MR Kamath was submitting, Justice Dixit observed that the words in order have to be read as they are. I cannot put it better than that.
AG : This GO is innocuous in nature. It does not affect any of the petitioners' rights.
AG : By the time, the State was informed that the issue was spreading to other institutions. The issue was not localized. Protest and unrest went on. So in that background, the impugned order of Feb 5 was passed.
AG: I must point out here. This resolution notes something very important. It is subtly informed that students from other communities are studying in the college. The concern of the committee is seen in that. This resolution is not called in question before this court.
AG: I am told that in the institution again the unrest continued and this led to another resolution being passed by CDC . This reiterates the same thing, except that it makes a positive assertion that children should not wear the hijab.
AG: All sorts of prayers are made. Initiate action against MLA, initiate action against officers. Some of the grounds made are that wearing of hijab is a right under the Act.
AG: Another resolution came to be passed by CDC, it was decided that status quo ante be followed. It is a plea to parents to follow the uniform. After the order came to be passed, interestingly, this present writ petition came to be filed. There was no GO of 05.02.2022
