ED Moves Delhi HC Against Arvind Kejriwal's Bail : Live Updates From Hearing
Singhvi: Leave is granted against Justice Swarana Kanta Sharma's order. My friend has argued it as if Justice Sharma's order is the final word. It is being considered by SC. If the arrest is bad, all other steps are irrelevant. It is the last word of SC which will come in July and not Justice Sharma's.
Singhvi: Justice Swarana Kanta Sharma and SC were dealing with legality of arrest and bail. This is so elementary that it is elemental. It is so simple.
Singhvi: SC has repeatedly said that when arrest is bad, there is no question of bail. Justice Sharma herself in para 4, a para conveniently forgotten by ED, says that I am not dealing with bail but arrest.
Singhvi: Yet Paras are read suggesting that this trial court judge should not have gone against them. Justice Sharma's judgment was carried in appeal in SC. The first line of SC order says leave granted.
Singhvi: It is unfair that this matter lasted for over five hours. 3 hours 45 mins were taken by Mr. Raju. 1 hour 15 mins were taken by Mr. Chaudhari.
Singhvi: This whole approach is deplorable and very sad. It should never come from a government authority but for long statutory objectivity of statutory body is lost as far as ED is concerned.
Singhvi: ED conception appears to be that a bail hearing, merely because it involves a CM must go on endlessly for hours without end. Must mean that judge must write an essay and if the judge doesn't repeat every argument of Mr. Raju, it will give opportunity for Mr. Raju to malign the judge. It is unfortunate.

ASG: He need not be an accused in the CBI case. That is what the SC has said. Yet the judge despite having shown the judgment, comes to the conclusion that ED is silent. I said it is not necessary. SC says so.

Chaudhari: What the trial court said was that confine to bail. And the grievance is that they weren't heard.
ASG: There are telephone calls between them when the money was being delivered. All of that not looked at.
ASG: Kejriwal decides to stay in a Grand Hayatt Hotel. Seven star hotel. He stays there for a few days. We have evidence to show that the money has gone from Bank Account of Chanpreet Singh to Hayatt. And the trial court says nothing. You can demolish my case but you cannot...
ASG: This is a fit case where stay should be granted.
