Singh: There are already four chargesheets, that's the reason I am giving. That court is at a far more better position to consider. I say even triple test isn't satisfied. He has already influenced witnesses and derailed investigation. My facts have to be told. Gravity of offence is other than triple test. My chargesheet is in final stage.

Singhvi: Arguments are four, is there any part of triple test, no. Have I being granted bail, yes. Can I influence? That's the only thing to be considered. My point is that today we can have a few minutes and the matter can be reserved.

Singhvi: The whole meaning of predicate offence is that the offence is same. It's same set of facts, with a much larger negative section 45 provision.

Singh: The SC order starts with the line that it's not on bail.

Singhvi: I am saying there is nothing more different. Of course it's your lordships discretion. Suppose your lordships decides against me. They are highly interrelated. This is nothing but a delaying tactic.

Singhvi: On June 20, a section 45 court gives me bail. On July 12 I get bail. It's same set of facts. It's not that in one case I am murdering him, in second I am a terrorist and in third its narcotics. Your lordships must decide the arrest and don't give bail but it doesn't mean it has to be deferred today. Bail requires minimum arguments from both sides.

Singhvi: This PMLA arises from Mr. Singh's predicate offence. Section 45 is much worse than gravity of offence. Your lordships gave it to me then. Why? Gravity is same. But they say I'll take one more day to argue on gravity of offence.

Singh: I didn't say that.

Singhvi: your lordships may reserve on both. It's the matter of liberty.

Court: It will need one full day more to argue on bail.

Singhvi: The main thing in such matters is triple test.

Singhvi: We are concerned that your lordships have heard us. I am now answering bail part. My submission is this answer of CBI on bail is a delaying tactic. I say so because in case everytime he says parameters are clear, you have concurrent power but don't do it here, no reason is given your lordships can't do it.

Court to Singhvi : First you need to resolve if this is for writ (plea challenging arrest) or bail. So far as bail is concerned, parameters are different. He is right to that extent that let us see the fate of the writ and then we'll see.

Singhvi: Ultimately what are considerations of bail. At the end of day, there is no question of evidence.

Court: There are various parameters of bail, one is gravity of offence.
