Sr Adv Mukul Rohatgi now makes submissions for D Srinivas, the former AG.
He submits that when the writ petition was filed, FIR was not registered. A judge recused from hearing. Then FIR was registered. The matter was mentioned before the CJ urgently and hearing was done.
Senior Adv Paras Kuhad seeks to add some submissions for the petitioner.
The bench says it will not hear any other counsel for the petitioner as Dhavan was heard.
Justice Bhushan : We are satisfied that the matter requires to be heard. Now, let us hear the caveator also.
Dhavan : I am pressing for an interim order also.
J Bhushan : We will consider that also.
'Was the High Court right to stay this investigation on the same day of the filing of the writ petition?, Dhavan.
Dhavan refers to the comparative charts of land values and the land transactions of accused persons.
'Should such a case not be investigated?', he asks.
Dhavan now refers to the documents relating to the FIR. He refers to the map of Amaravati.
'Why would farmers sell their lands during the period June - December in 2014?', he asks.
Dhavan : What is this writ petition? It is only a political petition against the government and the Chief Minister? And what is the basis - "reliable sources"! Even the "reliable sources" do not say anything!
Dhavan : The petition has averments against govt policies and decisions. It just makes rhetorical statements like govt has no regard for rule of law.
Dhavan : Would your lordships have stayed an FIR on the basis of allegations like 'nazi' 'gestapo' etc?
Dhavan : The writ petition uses expressions like 'as known from reliable sources'. Can that be a basis for mala fide argument?
The petition has only self created rhetoric.
