NOTE : The SC has not interfered with the HC order staying the investigation into the Amaravati land scam FIR.
Supreme Court list the matter for hearing in January. The SC requests the High Court not to decide the writ petition in the meanwhile. The parties directed to file counter affidavits in the meantime.
BREAKING : Supreme Court stays the Andhra Pradesh High Court's media gag order on reporting or social media comments on the contents of the Amaravati land scam FIR.
The bench is now dictating the order.
Dhavan refers to Sahara judgment and says - Media coverage of investigation cannot be stopped, it can be postponed as per this judgment.
Dhavan : The police had not even commenced investigation. It is only in extraordinary circumstances that investigation can be stayed.
Dhavan : The writ petition was filed in anticipation of the FIR. It is they who moved the court prematurely. And they are complaining that the FIR was filed on the day of filing of writ petition.
Dhavan refers to precedents to state that issue of malafide loses relevance if the complaint has substance.
Dhavan : Such orders (HC order) cannot be passed.
Dhavan : Is there an offence? The materials disclose offence. Was it a knee jerk reaction? No. CBI inquiry was also sought.
