Students of Jamia Millia Islamia University have moved the Delhi High Court seeking waiver of both the tuition fee and the fee charged for services not availed by students in light of COVID19.
Filed by the students of JMI's Faculty of Law, the petition argues that charging fee under heads such as canteen, development fee, cultural activities, etc. is immaterial as the services are not being availed by the students due to suspension of physical classes.
The Petitioners have further argued that the notification issued by the University demanding fee for the odd semester also violates the circular issued by the Bar Council of India which states that:
'considerate & compassionate to the hardship faced by students and also to adjust the savings of the university in terms of Electricity & maintenance of infrastructure against the fees charged.'
By citing examples of Patna University and CNLU, the Petitioners have contended that other universities across the country have also provided relief to students in terms of fees.
In light of this, the Petitioners have asked the court to quash the notification issued by the Dean of JMI University on 08/09/20 and direct reduction in fees demanded from students for the odd semester.
The petition has been filed through Advocates FA Khan and Nabila Hasan.
