The Delhi High Court has directed the Delhi Police to ensure that no encroachment happens on a 'Mandir' a part of which was claimed to have been demolished overnight by the Municipal Corporation. 

Directing that the layout plan of the temple must be ensured to be protected, Justice Sanjeev Sachdeva also directed the Police to ensure that there is no law and order issue in the area concerned.

"Petition is accordingly disposed of, directing the respondents to ensure that there is no issue of law and order in the area and the area depicted as mandir in the layout plan is protected and maintained as a mandir and no encroachment by any miscreant is permitted on the same."

The Court was dealing with a petition seeking directions on the Corporation to stop illegal encroachment and demolition of mandir and dharamshala situated in Noor Jahan Extension area. The plea also sought directions on the police to ensure that the said area is not encroached or demolished by miscreants.

It was the case of the petitioner that the dharmashala of the mandir had been demolished overnight in a haste and that the entire area had been leveled so that it can be encroached upon by illegal builders. Reliance was placed on photographs to show that demolition action was taken.

On the other hand, it was submitted by the Corporation that no demolition action was carried out by it and that the issue pertains to law and order and protection of the area, which would be the responsibility of Delhi Police.

"Learned counsel appearing for respondents No.1, 3 and 4 assures that the Police shall ensure that there is no illegal unauthorized encroachment on the said area and the area which is shown as mandir in the layout plan shall be preserved and protected. They shall also ensure that there is be no law and order issue at the spot," the Court recorded.

Accordingly, the plea was disposed of after directing the respondents to ensure no encroachment and protection of the mandir.
