The Allahabad High Court has sought the response of the Uttar Pradesh Government on a Writ Plea challenging certain questions asked in the Uttar Pradesh Teacher Eligibility Test (UPTET) 2021.
Essentially, 6 petitioners who appeared in UP-TET-2021 have moved the Court by submitting that certain questions that were asked in UP-TET and were successfully challenged before the Lucknow Bench of the High Court, were repeated in UP-TET-2021.
It was also submitted by the Senior Advocate that all those questions were repeated examination with different answer-key, and in fact, the answer key contained wrong answers.
Observing that the matter requires consideration, the bench of Justice Rajiv Joshi granted two weeks' time to the UP Govt either to seek instruction or to file a counter-affidavit with regard to the controversy involved in the writ petition.
The Court directed that the case be put up again on 25th May, 2022 as fresh. Significantly, the Court also made it clear that any selection made by the Examination Regulatory Authority U.P. (U.P. T.E.T) 2021, Prayagraj would be subject to the final decision of this writ petition.
The present writ petition has been filed for the following reliefs:
(i) Issue a writ, order or direction in the nature of certiorari quashing the final answer key dated 07.04.20222 and final result of UP-TET Examination 2021 dated 08.04.2022 issued by Examination Regulatory Authority, Uttar Pradesh, Allahabad i.e. Respondent No. 2 for the appointment of teachers for Class I to V.
(ii) Issue a writ, order or direction in the nature of mandamus to revise the result and to grant grace marks to the petitioners for the questions which were wrong and which were out of syllabus in the Uttar Pradesh Teacher Eligibility Test 2021 conducted by the respondent no.2.
(iii) Issue a writ, order or direction in the nature of mandamus to direct the respondent authorities for redressing the greivance of the petitioners by appointing the High Level Expert Committee for the result of Uttar Pradesh Teacher Eligibility Test 2021.
(iv) Issue a writ, order or direction in the nature of mandamus thereby directing the respondent authorities to delete the questions from the question paper, the questions which were wrong and which were out of syllabus and thereafter declare the result of UP-TET 2021.
(v) Issue a writ, order or direction in the nature of mandamus to the respondent authorities to postpone the recruitment process for the post of Assistant Teacher Recruitment Examination till the disposal of this writ petition.
(vi) Issue a writ, order or direction in the nature of mandamus to the respondent authorities directing to postpone the SUPER TEACHER ELIGIBILITY TEST (Super TET) till the disposal of this writ petition.
