Gujarat HC Refuses To Stay JEE(Advanced) Exam Results, But Says Results Subject To Further Orders [Read Order]

The Gujarat High Court on Wednesday refused to stay the results of the 2018 JEE (Advanced) examination scheduled to be declared on June 10.

Justice Biren Vaishnav asserted that the "declaration of the result has all India ramification", but clarified that the results shall be subject to further orders that may be passed. The Judge also issued notice to the organizing chairman of the JEE (Advanced) at IIT Kanpur, and listed the case on June 12.

The Court is hearing a Petition filed by three aggrieved candidates — Anurag Jha, Chandni Tomar, and Rajesh Rai — through their lawyer Rahul Sharma, alleging that IIT-Kanpur issued "clarifications regarding answers of numerical-answer-type questions" on 21 May, a day after the exam was conducted.

The Petitioners allege that the clarification "substantially altered" the instructions, and brought in a concept of 'a range of correct answers' as against original provision for 'correct answers truncated/rounded off to two places of decimals'. The answer key released on 29 May was also based on the clarification issued later.

The subsequent instructions, they say, would result in injustice as the result would certainly vary on the basis of the instructions given subsequent to the examination. This has been asserted to be violative of Article 14 of the Constitution of India as being arbitrary.

They have therefore demanded that the clarification and the answer key be quashed, and that the results be declared on the basis of the instructions contained in the question paper.
