Singhvi: And governors are no longer angels.
CJI DY Chandrachud: The very same unit which affects the numerator also affects the denominator. If the governor cannot find if numerator is affected, he cannot say that denominator is affected.
Singhvi: Absolutely!
CJI DY Chandrachud: Until the disqualification is known to the governor he cannot? After the disqualification is decided by speaker, there would be clarity with governor regarding numerator and denominator.
Singhvi: This is an exercise which he cannot embark upon.
CJI DY Chandrachud: Can he not say this exercise i want to see on the floor?
CJI DY Chandrachud: Can the governor not say that there is no recognisable concept of split, these people have to be reduced both from numerator and denominator?
CJI DY Chandrachud: In assessing a ruling party strength, you have a numerator and denominator. Numerator is strength of party, denominator represents strength of house. As per you the governor recognises part of the numerator.
CJI DY Chandrachud: You say that the governor essentially recognised the split. Your answer is that so long as the disqualification is pending, he can't.
Singhvi: Except for some freak reason where none disqualifies
Singhvi: Governor is recognising ABC as a party in majority. He is giving or imparting legitimacy and status. How is that possible?
Singhvi: Zero power when there are pending disqualification proceedings. One is a vanilla government running. Another is a government with pending disqualifications at two levels.
CJI DY Chandrachud: You said that this is not a case where a trust vote is called when the house is constituted for the first time. Very valid point. What is the power of the governor of calling trust vote post formation of government?
