Sibal: No meeting of political party took place at the instance of Eknath Shinde. That alleged meeting happened to take place on 18th July after all this was over & the petition to have symbol was filed on 19th July, the very next day.
Sibal: So you give legitimacy to those against whom disqualification proceedings are going on & such legitimacy which allows them to topple government with another party that is an opposition in that very state! That's the legitimacy the judicial orders have given.
Sibal: Can anyone say that this is not anti-party?
Sibal: You can't interpret the tenth schedule in this fashion to allow the government - the elected government - to fall. That's why I said that it's the orders of the court which resulted in this.
Sibal: Can the tenth schedule countenance a situation where a majority or minority of MLAs just do this? Forget majority, let's say it's a minority. A minority outside the state says that I am the party.
Sibal: Prior to the passing of this judicial order, all that was happening was happening outside of Maharashtra, in a state in North East. By whom? Members of legislative assembly. There was no party- no meeting of the party.
Sibal: So now the majority of legislative party can decide who's going to be the leader- while sitting in Assam?
Sibal: He had to be member of legislative council. So the then CM became member of legislative council. Meanwhile someone had to be appointed as leader of house. So Eknath Shinde was the leader of house. And he was removed by decision of party.
Sibal: No speakers elections took place. There was a seat from legislative council- he had to use that seat. He wouldn't hold elections for six months! First you swear in someone then he resigns. This tells us how the constitution functionaries are acting off late.
Sibal: How can the governor swear in someone without knowing if they had majority - in the early hours of morning?
