Dr. Dhavan says that he does not support the adjournment application.

"We don't go judge-hunting. It is immaterial if this judge is retiring or that judge is hearing", Dhavan says

Dhavan says that Bhushan would like to make a statement.

"Please have a congenial atmosphere. Don't go to all this extent, Dave saab. We have to maintain the dignity of our system" , Justice Mishra tells Dave.

Dave tells the bench that the AG has been waiting in the matter after notice.

Justice Mishra says "we are not aware of it. Don't remind us about that". 

Justice Mishra tells AG that the bench is not inclined to entertain the petition for deferring hearing, and that there was no need to hear AG on that application.

Attorney General : Your lordships had issued notice to me. If your lordships want to hear me, I will be happy to submit.

Dr Rajeev Dhavan now requests the bench to hear the Attorney General on the issue and says that he will make submissions on hearing after that.

Justice Gavai : You could have filed review even now. Statement was made by Dr. Dhavan on Aug 17 that review will be filed.

Dave : Why should I file review now? Then SC Rules must be amended to say review should be filed within 24 hours.

'If your lordship's conscience dictates that the hearing on sentence should be done now, I bow down. Your lordships have made a fair suggestion' : Dave.

Justice Mishra reiterates the assurance: "We assure you will not do anything to defeat your right of review. We are not proposing to defer the sentence hearing".

Justice Mishra says that it is never done like that.

"It (referring sentence hearing to another bench) is not appropriate. It is against established procedure and norms. Suppose if I am not emitting office, can it be ever thought of?", Justice Mishra says.
