SG: We have checked all the petitions, there was no such challenge against provisions other than Section 50 and 63. Thereafter, an amendment to the petition was filed. It changes the entire structure. They have added 5 new prayers, challenging virtually everything...
SG Tushar Mehta: Your Lordships had passed this order in March 2023 in Govind Singh v. Union of India. List when this bench is sitting in combination of three judges. Ss 50 and 63 of the PMLA was under challenge. Again in another petition, these provisions were challenged...a skeletal petition.
SG Tushar Mehta: Possibly they were tempted to have a wider argument. That is why on the last date, the petitioners started arguing on a wide canvas about Section 3 etc etc. I had objected to this saying that there are no such pleadings.
