A 5-judge bench of the Supreme Court will consider the curative plea filed by Akshay Kumar Singh, one of the four death-row convicts in the 2012 Delhi gangrape and murder case.

The petition will be considered by a bench comprising Justices N V Ramana, Arun Mishra, R F Nariman, R Banumathi and Ashok Bhushan at 1 PM in chambers.

The hangings of all the four convicts are scheduled on February 1 at 6 AM.

On January 14, the same 5-judge bench had dismissed the curative pleas of Mukesh Singh and Vinay Sharma, the other two convicts in the case. Mukesh later submitted a mercy petition before the President, which was rejected on January 17. Today, a three judge bench of Justices R Banumathi, Ashok Bhushan and AS Bopanna dismissed his writ petition challenging the rejection of mercy petition by President.

Last month, SC bench comprising Justices Banumathi, Ashok Bhushan and A S Bopanna had dismissed the review plea of convict Akshay, after which a Delhi court issued death warrant against the convicts. The review petitions of other three convicts were dismissed by SC in July 2018.

The death penalty was upheld by the Supreme Court on May 5, 2017.

On December 16-17 night, 2012, a paramedico student was gang-raped in a moving bus by five men and a juvenile. Few days after, the victim had succumbed to the brutal injury caused to her by them.

Prime accused Ram Singh had committed suicide in the Tihar jail in March 2013.

Convicts Vinay Sharma, Akshay Kumar Singh and Pawan Gupta have not yet submitted mercy pleas before the President.
