CJI DY Chandrachud: Except in one or two cases, it seems that there have been no arrests at all.
SG Mehta: That would be added once the postmortem would be done.
Justice Pardiwala: The son was burned in this incident. Why is 302 not added in this FIR? 354 is there- outraging women's modesty is here, burning house is there. Why is 302 not here?
SG Mehta: In this other incident, CCTV is available but could not identify the assailants as the mob had hundreds.
"FIR was registered on 7th of July in respect of an incident of 4th of May. It was a serious incident", CJI said referring to an incident of a woman being dragged out of a car and her son being lynched to death.
SG Mehta: A biased investigator would have said that there was no CCTV. We said we checked CCTV, it was auto deleted.
SG Mehta (referring to his note): This is to show that investigation was going on before your lords took cognisance.
Jaising: See this- "Data was auto-deleted by the system." CCTV is deleted, that is evidence lost. That shouldn't happen.
CJI DY Chandrachud: One thing is very clear- there has been a long delay in registration of FIRs.
SG Mehta: This is our surmise. The second FIR can be the same occurence reported on the second occasion. This is surmise. I'm not factually sure about it.
SG Mehta: That's wrong...
CJI DY Chandrachud: Don't share these copies with anyone, we'll redact in our copies. Don't give to media etc otherwise the names of women will go out.
SG Mehta: I have not shared...we have our own copies. We just gave a copy to the bench.
