Jethmalani: Court has said that order made on March 31 against misreporting and fake news is an order under Section 188 IPC, which is a cognisable offence.
Jethmalani: Sudarshan TV case is still sub-judice so i will not go into details. The Court has observed that sources of funding must be made publicly available (note that yesterday, Counsel had alleged funding from unknown sources to Duaโs Channel)
Jethmalani: Iโm only focussing on his statements against the pandemic and the subsequent exploitation.
He has made derogatory statements against the CJI.
He has made a statement against the PM, he has abused him too.
Jethmalani: Court has made observations that every electronic media enterprise should publish their source of funding publicly.
Jethmalani: Dua has asked people to raise their voice, come out on the streets and be violent like Americans have become, despite the lockdown. This man has tried to exploit a gigantic pandemic. He is a fly-by-knight operator who deserves to be investigated.
Jethmalani: He says in one of his broadcasts, โlacs of people are on the streets in America despite the lockdown and have also gotten violent...โ
He then speaks of Migrant workers, he has called for โCivil disobedienceโ
Jethmalani: To say that these quarantine centres were not more than detention centres - he was trying to dissuade people from being sent to them, he was trying to spread disease by saying all this. He has also not refuted this in his rejoinder.
Jethmalani: He has said that stones were thrown by a particular community because they thought they were being sent to detention centres. He said โpeople are saying thisโ - first sign of a rumour.
This story of his was false, if it is false, he is guilty of inciting violence.
Jethmalani: He has also said that the Delhi Riots were a pogrom against the Muslims. I dont want to comment on that, iโll talk about the pandemic.
Jethmalani: This gentleman did exactly what was prohibited by the top court on March 31 (viz. Fake news)
