JI Bobde : We are trying to discourage Article 32 petitions.
Sibal : Your lordships have interfered in 32. This is a journalist. There are exceptional circumstances.
Bobde : Alright. We will issue notice. But we might still send you to HC.
CJI Bobde : You haven't filed the amended petition too.
Sibal : How can we file the amended petition when we cannot meet this gentleman in jail?
CJI Bobde : We will keep it on Friday. You get the State then.
Sibal : I can't go to the High Court. He is not allowed to meet anyone. He is in jail.
CJI Bobde : But you have come here.
Sibal : The advocate has filed an affidavit saying that he could not meet Kappan in jail.
CJI Bobde : We are not on the merits of the case? Why can't you go to the High Court?
Sibal submits that FIR does not mention Siddiqque Kappan. Magistrate did not allow Kappan to meet his lawyers or family or friends.
