AG refers to Supreme Court's observations against protests while matter is sub-judice.
Justice Dixit : When I was a student, such things never happened that I would be remained away from the college.
AG says that in the farm protests case, the Supreme Court passed an order against protests when the matter is sub-judice.
AG : Such statements will send a wrong signal. All that I am saying is that, as the Court is hearing, there should be no protests, bandhs etc. And statements like girls in hijab are being attacked, they are dangerous. State is in control.
Kamat : I completely support the learned AG. Once we are before your lordships, no one can take law into the hands. Some vested interests are taking law into their hands. There are images of girls wearing hijab being chased by other boys.
AG objects to this statement.
Advocate General : I want to make a submission. Even as the Court is hearing, there are some parallel agitations. When the Court is hearing the matter, let there be an interim order that there should be no public protests or demonstrations.
Justice Dixit: For how long they have prevented from attending the college now?
Kamat : I represent the students from Kundapura college. They have been stopped for past 4-5 days.
Kamat makes a prayer for interim order: Considering the fact that they have been attending classes with head scarves for long, and that the exams are in the offing, kindly allow them to attend classes, based on balance of convenience.
Kamat now summing up his submissions.
First, this is a complete affront to right under Article 25, 19 and 14.
Second, the ground taken of public order cannot pass the muster.
Kamat on the next proposition that the GO issued under Section 7 of Karnataka Education Act is beyond the powers of the State. State has no power under the provision to prescribe dress code.
