Sibal: What’s happened really was, when all this material was collected based on the complaint, it wasn’t limited to Gulbarg. The complainant was a resident of Gulbarg, so it was sent there.
Sibal: I want an investigation, that’s all I want. I don’t want any convictions at this stage.
Sibal: Refers to the complaint filed by Zakia Jafri: Where does it say it's about Gulbarg? There are 60 names.
Sibal adds: This is not a political issue, it’s an administrative failure of the state that I am concerned with.
Sibal: If we limit it only to Gulbarg, what happens to rule of law, what happens to all material! What will ever happen to this!
Sibal adds: A Republic stands or falls on the basis of what the court does!
Sibal: Forget that, Am I not entitled, when I bring something to the notice of Magistrate, what is he to do? Have your Lordships ever said he will not look at it, will return it? When there are official documents to suggest the kind of crimes that were committed?!!
Sibal: How are 60 people involved in a complaint limited to Gulbarg? They were not!
Sibal: Yes it was filed. Expect when the matter came to SC, SIT investigation was beyond Gulbarg, which is why the matter was sent to Magistrate.
SG: I only want to factually assist. In the original complaint that was filed by Zakia Jafri, she stayed in Gulbarg society, that offence was registered. The complaint was omnibus one against 60+ persons, since it was concerned with Gulbarg society, it was filed in that.
Bench: There may be more than one crime reported. The 178 report pertains to that crime, that’s our understanding.
Sibal: When the court was talking about the report of SIT, it wasn’t talking about only Gulbarg, otherwise there’s no point of 172.
Bench: It says it was in respect of Gulbarg society case.
Sibal: SIT was not just investigating Gulbarg, it was asked to investigate all matters.
