Farmers Protest : Supreme Court Proposes To Stay Implementation Of Farm Laws- Live Updates
CJI : We are aware of those judgments. We are also aware of the Maratha bench judgment which stayed the implementation of Maratha reservation.
CJI to AG : We are sorry to say that you, as the Union of India, are not able to solve the problem. You have made a law without enough consultation resulting in a strike. So you have to resolve the strike.
Attorney General says that there are Supreme Court precedents saying that Courts cannot stay legislation.
CJI : No, no. That is not the complete picture.
CJI : Today's newspaper says that there is one political party which says that the Supreme Court should not decide on the policy of the law.
Tankha : If your lordship cannot decide, who can decide?
CJI : This is the quality of public discourse now.
Tankha says he is welcoming the suggestion from the bench to stay the implementation of the farmers laws.
Senior Advocate Vivek Tankha says he wants to say something on behalf for farmers from Madhya Pradesh.
CJI : We will hear at length on the constitutionality later. Not at this moment.
Sharma says that he has also challenged the constitution amendment which included entry relating to agriculture markets in concurrent list.
CJI : We are not going to stay a 1954 Constitution Amendment.
Advocate ML Sharma submits that the protests have been peaceful without violence and it was the police which is causing the problems.
Salve : If your lordships are staying the laws, then let the farmers call off the protests.
CJI : Mr.Salve, everything cannot be achieved with one order. Farmers will go before the Committee. Court will not pass an order that citizens should not protest.
