Do Something As SCBA President To Streamline Filing & Arrangement Of Files : Justice Bela Trivedi To Kapil Sibal

The Supreme Court today expressed concern over the lack of streamlining of case records while hearing an insolvency matter. 

A bench of Justices Bela M. Trivedi and Satish Chandra Sharma was hearing Senior Advocate Kapil Sibal in the matter when Justice Bela faced some issues with the case records.

She orally remarked: "Mr Sibal, do something as the President of the Supreme Court Bar Association to streamline the filing and arrangement of files and other things. It's really consuming and wasting time like anything."

Justice Bela added that even if parties provide the convenience compilation, it becomes difficult to navigate through it because there are so many files. 

Sibal responded by saying "it is the system at fault including ours". However, J Bela stated that there is, in fact, "no system" in place and "everybody does whatever they like".

Both Justices Bela and Sharma averred that there are better systems in place in the High Court and District Courts. 

Justice Sharma said: "You must have argued a number of cases before the Delhi High Court. It is so systematic."

Justice Bela added that the Courts are compelled to pass judicial orders to tackle this and something needs to be done about it. 

Sibal stated that there is a forum to handle and manage the case records and assured that he would raise this issue in the next meeting of the SCBA and added that we must make sure that the "public time" is saved.
