Sibal: What we are dealing with is a bail application.
Bench: That’s what is troubling us. In a bail application, this is being said. The bail granted to students, we are not disturbing. But we will otherwise stay the effect of the judgment.
Solicitor General : The High Court says merely because riots were controlled, UAPA is not attracted. So what does this mean? Tomorrow if a bomb squad diffuses bomb, will it cease to be a terror plot.
Bench: We understand that the way the Act has been interpreted. That’s why we are issuing notice.
SG: 53 persons died of which many were police officers. 700 people injured. These three people conspired.
ASG Aman Lekhi: I am also appearing. There are three facets which are important. It imputes an ambiguity in Section 15 which was not even argued.
SG: The incident takes place because the President of US is visiting, these are the statements of the people.
SG: In the meanwhile, please stay this order. Lawyers are moving for bail relying on this. It is virtually an acquittal order. Trial court will have to entertain a discharge application and replace it with this judgment.
