Justice Singh states that the main issue is bypassing of the Academic Council and that Mandeep Singh will be taken by the DB.
“There is a clear overlap in both the pleas”.
Justice Singh notes that, despite both being different, they are still working bodies, and the prayers are linked.
She further notes that Lakra squarely covered Mandeep Singh, and so she will only hear the Anupam case.
Adv. Hora says that the challenge is to the legality of the High Powered Committee which was suddenly constituted on 7th July.
“What we are challenging is the HPC. They changed the working body and both were illegal”.
Justice Singh says that the prayer in Lakra was about challenge to OBE taken place without consultation with the Academic Council and it is the same in Mandeep Singh.
Adv. Hora clarifies the difference in the two pleas and how suddenly a High Powered Committee was constituted.
Adv. HS Hora, appearing in Mandeep Singh plea, submits to the Bench that he wishes to clarify that the grounds in Akshay Lakra are not the same as Mandeep Singh.
“In one specific prayer, it has been listed for 6th Aug. I am not pressing that prayer today & I have no problem”.
Adv. Apoorv Kurup informs the Court that the plea seeks for extension of time of the duration of the exam.
Justice Singh requests him to the show the plea to her.
Adv. Akash Sinha submits that they had filed an IA in the matter before SC, but the matter had not been taken up today and would be listed on 10th Aug.
Adv. Apoorv for UGC interjects that the matter was taken up and heard at length.
Adv. Rupal for DU submits that a new SLP was listed before SC today and that the order of the DB has not looked into the aspect of OBE. He informs the Court that he hasn’t received the copy, and the order is with respect to the matters pending before the DB
