Arvind Kejriwal's Challenge To ED Arrest : Live Updates From Delhi High Court Hearing

Singhvi: These three statements (of Raghav Magunta) are avoided, suppressed and not allowed to be used as exculpatory by putting in unrelied. It's a fraud for a prosecutor to say that I'll simply keep documents as unrelied and avoid scrutiny by court. It's against element of fair play.

Singhvi: It's a completely biased approach. It's not the way criminal law can be applied.

Singhvi: Material and necessity is also emphasized in Ashish Mittal judgment. Then come the general cases, Arnesh Kumar etc.

My next point is this whole unfortunate system or completely turning criminal law on its head. First in several statements there will be nothing, Raghav Magunta, Sarath Reddy and Magunta Reddy. Nothing against me. Step 2, some of them arrested. Step 3, first time they give statement against me. Step 4, they are given bail without any objection. Then they get pardon and approvership. Five is unique, one of them is a candidate from the ruling party in the current elections. That is Magunta Reddy and the second one is shown to have purchased bonds, that is Sarath Reddy.

Singhvi: Today I found an extraordinary point at least from press and the counter. Counter says that the accused himself said in a proceeding that he doesn't challenge custody, therefore the prior petition coming up today is rendered infructuous as if we're dealing with a civil case. It's a plea unheard of.

Court: I don't think it will be too difficult for us.

Singhvi: One person there will give them the correct pages.

Raju: We'll adjust, thats not the issue. The issue is a wrong copy was given to us. That is not done.

Raju objects, says he has been given a wrong paginated copy of the petition.

Singhvi says Raju is trying to adjourn the matter. 

Singhvi: See the remand application. Which itself suggests that they want in futuro to find out the role of Chief Minister. Surely that's not a ground for today's arrest.

The other part of necessity to arrest is, can this person be a flight risk? What can he do after one and half years in terms of witnesses? Which part of cooperation I'm not doing?
