Jaising : The main issue is that man is suffering from dementia. He is mentally compromised. From what I heard from the report, there is no mention about these.
Public Prosecutor Deepak Thakare says the report from Taloja jail has been filed.
Jaising says she has not receivied it.
Prosecutor : I did not have her number. Otherwise I would have whatsapped her.
Jaising : The petition copy was served in advance.
The bench observes that the constitution of a medical board will take time and if there is a medical examination by a panel of doctors of Nanavati, it will be known soon if his shifting is necessary.
ASG Anil Singh (for NIA) : I am told that the jail doctors are consulting doctors of Nanavati and JJ hospitals for treating Varavara Rao. As far as examination by Nanavati, the State counsel may be in a better position to submit.
The bench asks what is the harm in permitting the medical examination of Varavara Rao by doctors of Nanavati hospital.
NIA's counsel : We have always provided him the best medical treatment at jail, at Nanavati and JJ hospitals.
NIA's counsel : It was not on the basis of any orders of the Court that Varavara Rao was shifted to Nanavati hospitals. It was done by the State on its own.
NIA's counsel : We cannot underestimate our government hospitals or government doctors. But at the request of family of Varavara Rao, he was shifted to Nanavati hospital, a speciality hospital.
The bench now turns to ASG Anil Singh, who is appearing for the NIA
Jaising : I do not wish to take an adjournment to reply to NIA affidavit due to the urgency of the matter.
