Rajasthan High Court has rejected a plea alleging that the District Hospital in Deoli was being set up adjacent to the land belonging to Municipal Board Chairman's wife, in order to appreciate her land's value.
The bench of Justice Avneesh Jhingan ruled that setting up a hospital is a policy decision and the Court could not sit in appeal over it.
It was the case of the petitioner that the hospital was being set up at the designated land merely because the land was adjacent to the land of the wife of the Municipal Board's chairman.
It was argued that despite there being more suitable places available in Deoli for setting up the hospital, the designated land was chosen to appreciate the value of the land of the Chairman's wife.
Unimpressed by the arguments put forth by the petitioner, the Court opined that the mere fact of the Chairman's wife's land being adjacent to the designated land for the hospital did not by itself establish any ground to allege malafides. Hence, deciding a place for setting up a hospital being a policy decision, the Court would not decide an appeal against it.
Furthermore, the Court also highlighted that the allegations were made by the Petitioner without impleading Chairman's wife as a party to the present case.
Accordingly, the Court decided that there was no reason to interfere in the order of the Municipal Board, and the petition was dismissed.
