The Allahabad High Court has asked the Bar Council of Uttar Pradesh to issue guidelines that the Advocates should avoid wearing uniforms outside the Court premises.

The direction was issued by a bench of Justice Sangeeta Chandra and Justice Narendra Kumar Johari taking note of many instances wherein Advocates had assisted land mafias in grabbing citizens' property of citizens while donning their uniform.

The occasion to make this observation by the bench arose while hearing a criminal writ petition filed by a local lawyer Subhanshu Singh who had alleged that in September this year, he was assaulted by some lawyers in the Civil Court premises in Lucknow and he sought an independent probe into the matter.

In his plea, he apprised the Court that he had lodged an FIR in connection with the incident and now he is constantly being threatened by the private respondents, who are all anti-social elements against some of whom history sheets have been drawn up by the Police Authorities.

Having heard his plea, the Court directed the counsel appearing for State Respondents, the AGA, to inform the Additional Deputy Commissioner of Police of the area concerned about the filing of the writ petition and seek instructions about what has been done in pursuance of the F.I.R. lodged by the petitioner.

Further, the Court directed the Senior Registrar of this High Court to send a copy of the writ petition to the District Judge, Lucknow and seek his comments concerning the steps taken in pursuance of the letter sent by the petitioner dated 25.09.2023 to preserve the C.C.T.V. footage of the area of the court where the alleged incident took place.

Lastly, the Court also directed the advocate appearing for the State Bar Council to inform the State Council about several cases being filed before the HC alleging Advocates in uniform going to intervene in private property disputes and assisting the land mafia in grabbing the property of citizens.

With this, the matter has now been posted for further hearing on November 28, 2023.
