Failure To Repair TV Under Warranty, Thiruvananthapuram District Commission Holds OnePlus Liable

The District Consumer Disputes Redressal Commission, Thiruvananthapuram (Kerala) bench of P.V. Jayarajan (President), Preetha G Nair (Member) and Viju V.R. (Member) held OnePlus liable due to its failure to repair the television despite it being within the warranty period.

Brief Facts:

The Complainant purchased OnePlus Full HD Smart Android TV from Flipkart on 24/07/2022. On 18/07/2023, an issue arose with the television remote which prompted the Complainant to file a complaint with OnePlus. However, after 4 to 5 days, the service request was unfairly marked as canceled. Consequently, the Complainant lodged multiple complaints with OnePlus yet the issue raised was not resolved.

Feeling aggrieved, the Complainant filed a consumer complaint in the District Consumer Disputes Redressal Commission, Thiruvananthapuram, Kerala (“District Commission”) and filed a consumer complaint against OnePlus. OnePlus didn't appear before the District Commission for the proceedings.

Observations by the District Commission:

The District Commission noted that the evidence indicated a one-year warranty for the product along with an additional one-year warranty for the panel. The Complainant lodged several complaints concerning the malfunctioning of the television and its remote control. Despite being duly informed, OnePlus did not appear, leaving the Complainant's deposition unchallenged and their evidence uncontroverted.

The District Commission held that OnePlus was obligated to resolve the issues raised by the Complainant within the warranty period but failed to do so. Therefore, the District Commission held OnePlus liable for deficiency in services.

Consequently, the District Commission directed OnePlus to pay a sum of Rs. 17,286/- to the Complainant. Additionally, OnePlus was directed to retrieve the television set and pay a compensation of Rs. 5,000/- to the Complainant for the mental anguish suffered, along with Rs. 2,500/- towards the cost of the proceedings.
