[NLAT LIVE] Hearing On Plea Against NLSIU's NLAT2020 [LIve-Updates From Supreme Court]
Datar: They say I have violated the Rules, where is the provision to hold a general body meeting? Where is the provision to transfer the funds to Hyderabad? What about the Consortium's conduct?
Datar: For its autonomy, can conduct separate exam.
We said that we will go back to #CLAT2020 next year.
If for some reason, unable to comply, say in light of extraordinary situation, i can conduct my own exam.
Datar: By-laws not fully implemented, for MPHIL we are conducted our own exam.
If for a particular examination, to maintain its autonomy, separate exam has to be conducted.
Datar reads the by-laws, objectives and the functions, constitution of the Governing body.
This is only a society, not cooperative society. We are registered under the Societies Registration Act.
Datar: I am now on the By-laws of the Society. I will make good my submission that the By-laws fall upon the parties like a contract.
Datar: Deliberately they postponed the CLAT. I repeatedly said that it needs to be held sooner.
Justice Bhushan: Have you signed this?
Datar: No. This was an email copy. How can i sign it when the EC has asked me to conduct the exam independently if CLAT not conducted by 7th.
Datar: Governing body is the Apex body and when it has decided already for 7th September to hold CLAT, then why was the same not done to postpone it further?
Hold it on 8th or 9th, why delay it more?
Datar: Meeting of consortium held on August 27. They say that my consent was taken, my stand is that it was not taken.
Datar taking the bench through the instances which highlight the number of times the Consortium was conveyed that the NLSIU could have delayed having the #CLAT2020 further.
Justice Reddy: So you are a part of the consortium or not?
Datar: I have not exited the Consortium. For #CLAT2020 I am no longer part of it. They have asked me to transfer all records & accounts to Hyderabad. I have not exited.
